NEW FORT BRAGG CITY ORDINANCES The Fort Bragg City Council recently passed two new ordinances that will become law on February 26, 2009. CULTIVATION OF MEDICAL MARIJUANA
9.32.010 through 9.32.040 are new ordinances that regulate the cultivation of medical marijuana. Outdoor cultivation is illegal anywhere within the City. Indoor cultivation is limited to “Qualified Patients” and “Primary Caregivers”. The indoor grow is limited to 50 square feet of floor space and a total of 250 cubic feet, per parcel. Other restrictions apply, so be sure to refer to the above ordinances for a complete understanding of the laws regulating the Cultivation of Medical Marijuana within the city limits of Fort Bragg. PROHIBITION OF SMOKING IN PUBLIC PLACES
6.18.050 C, D and E are new ordinances that cover the prohibition of smoking in public places within the city limits of Fort Bragg. Smoking of tobacco or any other plant material is prohibited within twenty feet of the entrance to any business or along the sidewalk adjacent to the building façade. This covers all businesses and sidewalks in the Central Business District as defined in Section 1.04.010. Any business outside the Central Business District may choose to have this ordinance enforced by posting a no smoking sign that refers to this section. Smoking is also now prohibited in all public parks within the city limits including C.V. Starr Community Center, Guest House and Town Hall Grounds, Noyo Beach, Pomo Bluffs Park, Otis Johnson Park and Bainbridge Park. |
